The Lysine Fair Trade Coalition and its members have filed a petition with the U.S. Department of Commerce (DOC) and the U.S. International Trade Commission (ITC) seeking antidumping and countervailing duties on imports of L-lysine from China.
Petitioners, including Archer Daniels Midland Co., CJ Bio America Inc. and Evonik Corp., allege lysine imports are being dumped in the U.S. market by China.
ITC will determine whether there is reasonable indication that the imports are injuring or threatening to injure the U.S. industry; DOC will determine whether imports are being dumped or unfairly subsidized and will calculate antidumping and countervailing duties that importers will need to pay.
ITC must reach a preliminary determination in its investigations in 45 days, or by July 14. ITC’s findings must be presented to DOC within five business days after that.
