Drive time limits waived once again in Kentucky

Emergency order exempts commercial motor vehicles and their operators from hours-of-service rules for transport of feed products and live poultry.

Transportation secretary says winter weather has resulted in distribution and delivery problems for animal feed

After another bout of winter weather, Kentucky Transportation Secretary Jim Gray has issued a second emergency order this season exempting hours of service regulations for delivery of agricultural and feed products.

The emergency order declaration was enacted on February 2 and will remain in effect until March 2. A similar order was issued from December 27 to January 20 after a period of prolonged period of below-freezing temperatures and icy conditions across Kentucky. The latest order also cites similar weather conditions.

“This situation has resulted in distribution and delivery problems for livestock feeds, particularly poultry feed, and the transport of live poultry from farm to other processing locations, resulting in transporting delays to the point that operations are severely impacted within the Commonwealth,” the order said.

According to the order, Gray declared a state of emergency, exempting commercial motor vehicles and their operators from the hours-of-service rules for transport of feed products and live poultry.

All other safety requirements remain in full force and effect, and drivers operating under the authorization of the emergency declaration should have a copy of the order in the cab of the vehicle.
